Welcome to SuperEasyChinese! These Terms of Use ("Terms") govern your access to and use of the SuperEasyChinese mobile application ("App"). By downloading, installing, or using our App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using SuperEasyChinese, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

SuperEasyChinese is a Chinese language learning application that provides:

• Interactive Chinese language lessons and podcasts
• Audio learning materials with transcriptions
• Progress tracking and personalized learning experiences
• Practice exercises and learning tools

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. Subscription and Payment

3.1 Subscription Plans

SuperEasyChinese offers subscription-based access to premium content and features. Subscription details, including pricing and duration, are displayed within the App and managed through Apple's App Store.

3.2 Billing

• Subscriptions are billed through your Apple ID account
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

3.3 Free Trial

We may offer a free trial period for new subscribers. If you do not cancel before the trial period ends, your subscription will automatically begin, and you will be charged the subscription fee.

3.4 Cancellation and Refunds

You may cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of your current billing period. Refund requests are subject to Apple's refund policies.

4. User Accounts

4.1 Account Creation

You may need to create an account to access certain features. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach

4.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activities that harm the App, other users, or us.

5. Intellectual Property Rights

5.1 Our Content

All content in the App, including but not limited to text, graphics, logos, audio clips, lessons, and software, is the property of SuperEasyChinese or its licensors and is protected by copyright, trademark, and other intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use. You may not:

• Copy, modify, distribute, sell, or lease any part of our services
• Reverse engineer or attempt to extract the source code of our software
• Create derivative works based on the App or its content
• Use the App for any commercial purpose without our written permission
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices

6. User Conduct

You agree not to use the App to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit any harmful, threatening, abusive, harassing, defamatory, or obscene material
• Impersonate any person or entity
• Interfere with or disrupt the App or servers
• Attempt to gain unauthorized access to any part of the App
• Use automated systems (bots, scrapers) to access the App
• Share your account with others or allow others to access your subscription

7. Content Accuracy

While we strive to provide accurate and high-quality educational content, we do not guarantee that all information in the App is complete, accurate, or current. Language learning outcomes may vary based on individual effort and circumstances.

8. Third-Party Links and Services

The App may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of these third parties. Your use of third-party services is at your own risk and subject to their terms and conditions.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• That the App will be uninterrupted, secure, or error-free
• That defects will be corrected
• That the App or servers are free of viruses or harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPEREASYCHINESE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your access to or use of (or inability to access or use) the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content

11. Indemnification

You agree to indemnify, defend, and hold harmless SuperEasyChinese and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SuperEasyChinese operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SuperEasyChinese regarding the use of the App and supersede any prior agreements.
